For the First time in the last 20 years, Islamic Republic of Iran has developed a list of projects containing onshore fields for development with exploration projects offering for foreign investment opportunities through buy - back schemes. Under this system, the foreign oil company makes the investment to bring the Company field underproduction, then hands it over to the Iranian National Oil (NIOC), in effect simply providing a service. The company then recoups its investment, plus an agreed rate of return through the oil and gas production from the field. Naturally, it is in the best interest of any nation not to share its natural resources with foreign entities. According to Code 81 of Iran's Constitution, the granting of any concessions regarding the essential affairs of the state is forbidden. The concept of buyback is actually a solution for the legal obstacles that some constitutions, including that of Iran, initiated in regards to foreign investment and right of ownership of land and natural resources in a given country. Thus this legal solution allows the contractor to have all the privileges of ownership during the period of the contract, without actually having any title under his name.</subfield>
